標題[課業] 保證人地位討論層次

做題目時有點疑惑上來問問 我是上保成鄭闕的刑法 老師在課程中提到保證人地位為罪責問題(與法益侵害無關) 所以要放在罪責層次討論 可是做李允呈的解題書卻在構成要件層次討論保證人地位 如某甲開車未關窗，行經廟會活動，有鞭炮丟入車內爆炸， 導致甲受驚嚇失控撞傷乙 這題就甲未關窗駕車之行為是否構成276過失致死之不作為犯之部分 我的寫法跟李師解答一樣在構成要件討論，甲不具保證人地位 因甲並未製造法所不容許之風險，不具客觀可歸責性，客觀構成要件不該當 如果按照鄭闕的說法放在罪責層次討論 該怎麼寫呢?? 有點搞混了，請大家幫忙解答，謝謝 -- ※ 發信站: 批踢踢實業坊(ptt.cc), 來自: 114.26.17.193 ※ 文章網址: https://www.ptt.cc/bbs/Examination/M.1430139443.A.AB4.html ※ 編輯: boylarry (114.26.17.193), 04/27/2015 21:00:07
