感謝baumen大為這鳥題去查書冏， 剛剛又去翻了一下劉宗榮老師書， 這爭議或這一說源頭的爭點，在船舶承攬人可否為法定抵押權，準用舊的513 劉師跟張師是反對的(513修法後這些書沒有更新或係沒有變更見解) 故劉、張二師書上看不到成立先後、占有這些說法，為必然 因為就沒有法定抵押權了，哪來的先後之爭 問題是，513，立法學者們居然還能吵個沒完，立法不是這樣立的吧喂喂大老師行行好啊冏 像謝在全老師等是認為513已經修成要登記才能生效了，但是謝哲勝師、朱柏松師、 黃健彰師、鄭冠宇師認為哪有決定改了，還是法定抵押權生對抗效 但是513修法除了黃師外，其他都是修法時在場的，不要玩考生啦… = =…所以嗯…如果真的要這麼麻煩，那就送他吧… 人生嘛總會一年遇上一二題死人題中槍 雖然我已經中槍到怒火滿點，一直不爽立法幹嘛不立好一點， 立法品質問題不在利萎豬公，而在自以為清高卻立法還是沒立好的學者們啊 -- ※ 發信站: 批踢踢實業坊(ptt.cc), 來自: 140.116.1.136 ※ 文章網址: http://www.ptt.cc/bbs/Examination/M.1404964564.A.D32.html ※ 編輯: sinksink (140.116.1.136), 07/10/2014 11:58:15 ※ 編輯: sinksink (140.116.1.136), 07/10/2014 11:59:11 ※ 編輯: sinksink (140.116.1.136), 07/10/2014 12:04:08
